Who we are and what these terms cover
These Terms of Use ("Terms") govern your access to and use of The Performance Matrix® website (the "site"). The site is operated by Comera Movement Science Limited ("we", "us"), a company registered in England and Wales (company number 03854711), registered office Origin Workspace, 40 Berkeley Square, Bristol, BS8 1HP.
By accessing or using the site you agree to these Terms. If you do not agree, please do not use the site. Please read them together with our Privacy & Cookie Notice.
These Terms cover your use of the website, including making an enquiry and buying a TPM licence through it. They are not the software licence or end-user terms that govern your use of the TPM system itself once purchased — those are provided separately at purchase.
Using our website
You may use the site for lawful purposes — to learn about TPM, to buy a licence, and to get in touch. You must not:
- use the site in any way that is unlawful or fraudulent;
- attempt to gain unauthorised access to the site, its server or any connected infrastructure, or disrupt it (for example by introducing malware or attempting to overload it);
- submit false or misleading information, or use our forms to send spam or unsolicited content;
- copy, extract or re-use content from the site except as permitted below.
Buying a licence
Licence purchases are processed by our payment provider, Stripe, on their secure checkout. Prices displayed there are the current live prices; nothing you enter into their checkout is seen or stored by us. A contract for your licence is formed when your payment is confirmed. Details of what each tier includes are described on this site; if anything is unclear, contact us before you buy.
Information only — not advice
The content on this site is general information about TPM and about movement screening and retraining. It is not medical, clinical or professional advice and should not be relied on as such by visitors. TPM is a tool for use by qualified practitioners exercising their own clinical judgement.
Intellectual property
The content, design, branding, logos and materials on this site are owned by or licensed to Comera Movement Science Limited and are protected by intellectual property law. This includes The Performance Matrix®, a registered UK trade mark of Comera Movement Science Limited (no. UK00908602583, registered 26 April 2010), and Kinetic Control®. You may view and print pages for your own reference. You may not otherwise copy, reproduce, republish or use them for commercial purposes without our permission.
Links to other sites
The site may link to third-party websites (for example our payment processor, or other Comera Movement Science sites). We provide these links for convenience only; we are not responsible for the content or availability of those sites, and a link does not imply we endorse them.
Availability and disclaimers
We aim to keep the site available and its content accurate and up to date, but we provide it "as is." We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, and we may change, suspend or withdraw any part of it at any time.
Our liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law (including liability for death or personal injury caused by negligence, or for fraud). Governing law
These Terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
